1. Acceptance of Terms

By accessing, browsing, registering, or operating any portal under the PexAura platform (hereafter referred to as the "Service", "Platform"), you explicitly agree to compile with and be bound by these Terms & Conditions. This Service is owned, managed, and legally operated by PexelParadox. If you do not agree to these terms, you must terminate your usage immediately.

2. Description of Services

PexAura is a digital SaaS platform providing a consolidated dashboard for business automation and communication workflows. These include:

• Customer Relationship Management (CRM) pipelines and contacts logs.
• Official WhatsApp Business API bulk broadcasting and template construction.
• Meta Advertising Platform Direct sync (Facebook & Instagram leads, webhooks, and direct messages).
• Physical Biometric Attendance log streaming and terminal synchronization APIs.
• Automated multi-digit Interactive Voice Response (IVR) phone trees and call tracking.
• Unified visual charts, logs, and report dispatch modules.

3. User Accounts & Eligibility

To use our Service, you must be at least 18 years of age and hold the legal capacity to form a binding contract. You are responsible for maintaining complete confidentiality of account secrets, API tokens, and access keys. Any transactions completed under your credentials will be considered authorized by your corporation.

4. Subscription and Billing (Razorpay Processors)

We operate subscriptions on a monthly recurring basis or custom annual plans, paired with a pay-as-you-go credit system for SMS/WhatsApp API consumption.

All online digital collections are processed securely via Razorpay. By subscribing, you authorize PexelParadox to charge your selected credit/debit card, UPI account, Net Banking account, or digital wallet for the fees accrued. All billing statements include local taxes (GST) where applicable.

5. Acceptable Use and Compliance Clause

You are strictly prohibited from utilizing PexAura for:

• Unsolicited spam messaging or violating local telecom spam acts.
• Transmitting illegal, abusive, defamatory, or fraudulent content.
• Attempting to bypass security safeguards or scrape internal services.

Users must fully adhere to the WhatsApp Business Policy and Meta Platform Terms. Non-compliance results in immediate operational suspension without refund.

6. Biometric Access Data Handling

PexAura provides software endpoints to listen to logs sent by your offices' biometric scanners. PexAura and PexelParadox do not receive or store raw biometric characteristics (such as full fingerprint images or facial features). We only process alphanumeric logs (e.g., employee IDs, scanner IDs, and timestamps) mapped inside your local structures. It is your sole responsibility to acquire appropriate worker consents before deploying physical logging integrations.

7. Intellectual Property

"PexAura", the PexAura emblems, logo patterns, visual shaders, and code components are trademarks and copyrighted properties belonging exclusively to PexelParadox. All rights reserved. Meta, Instagram, Facebook, WhatsApp, and Razorpay are trademarks of their respective corporate owners.

8. Limitation of Liability

PexelParadox offers the Service on an "as is" and "as available" basis without warranties of any kind. Under no circumstances shall PexelParadox be liable for direct, indirect, incidental, or consequential damages (including loss of business profits, data corruption, or service lag) stemming from API downtime or account restrictions.

9. Governing Law and Disputes

These Terms & Conditions are governed by the laws of India. Any litigation, dispute, or claim arising from these agreements will be settled first through arbitration in accordance with Indian acts, and failing that, will be subject to the exclusive jurisdiction of the courts of Punjab/NCR region, India.

10. Data Deletion Protocol

PexelParadox adheres to a strict data protection policy. We do not sell or pass your data to third parties. All user data is encrypted with AES-256 standard and stored securely on our servers. Under GDPR and the Indian IT Act, you retain the absolute right to have your account and all associated communication logs, biometric records, and CRM entries completely and permanently erased ("fully deleted").

Once a deletion request is validated, we fully delete all records without leaving any shadow backups. We assume 100% full legal and technical responsibility for protecting and securely erasing our users' data.
